Agreement

Appendix 1 of terms and conditions

This being an agreement of association between Tabulae Limited hereafter referred to as Tabulae and ___________________ hereafter referred to as the Specialist.

1    Purpose of agreement

1.1    The Specialist agrees to abide by the terms and conditions set out in clause (3).
1.2    Subject to the Specialist complying with the specialists undertakings in clause 3 Tabulae agrees to carry out Tabulae’s undertakings referred to in clause (4).

2    Where the Specialist comprises of two or more persons

    The obligation expressed or implied to be made by or with the specialists are deemed to be made by or with the Specialists jointly and severally.

3    Specialist’s undertakings

3.1    To annually provide proof of public and or product (as applicable) liability to the sum of £5m (five million pounds).
3.2    To provide proof of CRB check in accordance with the Home Office’s recommendations.
3.3    To provide two references from previous employers from within the heritage and or educational industries.
3.4    To provide a written risk assessment for all activities undertaken during presentations.
3.5    To undergo Tabulae’s accreditation procedure every three years.
3.6    To pay all monies due to Tabulae prior to inclusion on the website each year.
3.7    To at all times conduct themselves in a professional manner and to abide by the terms and conditions governing Tabulae Association.
3.8    To maintain an appropriate standard of costume and presentation, for the duration of an engagement.
3.9    To authorise Tabulae to keep required information on a database in accordance with The Data Protections Act 1998. (NB: Authorisation may not be inferred by signing this agreement, and the separate consent form must also be returned.)
3.10    Each specialty offered to clients on a professional basis shall be presented for accreditation.
3.11    To inform Tabulae of any relevant changes in the Specialists circumstances. Including but not limited to: address, criminal record, change of business/periods covered etc.
3.12    To provide an internet link back to the Tabulae website where appropriate.

4.    Tabulae’s Undertakings

4.1    To provide and maintain a website listing all accredited associates, including the Specialist.
4.2    To advertise Tabulae’s website by means of correspondence, search engines, and word of mouth to prospective employers within the heritage and educational fields. Also by means of any future methods that Tabulae deems to be appropriate.
4.3    To establish and maintain a database of accredited associates.
4.4    To obtain permission from the Specialist to include the details in the database that they have provided in accordance with The Data Protections Act 1998.
4.5    To accredit specialists every three years by means of auditors, who will, report to Tabulae Ltd. The final decision on suitability for accreditation remains solely with Tabulae with no prejudice implied.
4.6    To manage any dispute between Tabulae and the Specialist in accordance with Tabulae’s grievance procedure.
4.7     To endeavour to provide information in accordance with the Home Office’s recommendations regarding children and vulnerable adults.
4.8     To endeavour to provide public and product liability insurance for all accredited associates if required by them.
4.9    Following any relevant, reported dispute, Tabulae will investigate the matter and take appropriate action where necessary in accordance with Tabulae’s terms and conditions of association.

5    Disclaimer:

5.1    All contracts and bookings between the Specialist and clients are to be undertaken by those parties and remain the responsibility of those parties.
5.2    Tabulae shall be indemnified from and against all actions, proceedings, costs, charges, expenses whatsoever in respect of any loss, injury or damage whatsoever to any person or property arising out of  but not limited to any such agreement made between the Specialist and any third party.
